I went to his house

yesterday he had police waiting for me said the dog was shipped to NJ he wont tell me where or with whom 2 days and the dogs in NJ come on this guy lives in a project type community he lied about everything, he told me he lived in assonet where he had plenty of land for the dog everything about him was false its real bad!!!

Unfortunately without a contract he may not be liable for anything.
At best this sounds like a small claims issue.

I don't think any rescue groups could help as the dog is personal property.

Ok, I'm no lawyer...

But if it could be reasonably proven that you would not have given the man the dog had you known his real identity, I could think it would still be potentially criminal fraud. I can't believe a contract would be needed for this.

If the dog was sold for personal gain then even more so.

ugh...real tough to prove a criminal fraud case here. The dog was free correct? So you have suffered no financial harm. You were not deceived out of any money or out of any services rendered. All you have here is a creep who misrepresented some facts so you would give him a free dog.

You could try a civil action for fraud, but again you must be able to prove damages. There was no contract or consideration. How will you quantify damages for a pet you were looking to unload for free?

NOW I AM PLAYING DEVIL"S ADVOCATE HERE SO DON"T TAKE THIS THE WRONG WAY, but a judge or clerk will probably question you as to your actions. If the placement of the pet meant so much to you, wouldn't a little due diligence and investigation on your part have been in order? If you had found out he lived in the projects and not a sprawling estate in Assonet you may not be in your current predicament.

This guy sounds like a dirt bag who needs to be taught a lesson, but I am not quite sure what remedy you'd be entitled to in a court of law.

But even though there was no money changing hands, the dog could be determined to have some value, and the creep obviously lied about his intentions. I would think this could constitute a verbal contract.

I hate to say it but this was over from the minute he got the dog and left.

The only action now is to beat his ass so he can't do it again to someone else, send me his name and I'll have some friends nose around and get some real background on him, not just what the cops know.

And if I find out things you don't like as in what really happened to your pet, I can put the word out on him with the under city crew.

These guys like dogs and hate scumbags like this Ahole and I'm sure they'd make him feel like a bait dog in a pitbull ring.

Remember, the monetary value of the dog was never in question, although the dog may have been "worth" $600, Mr. Macey set the value at $0 when he actively sought to give the dog away for free.

Pure Bred, Black, nice dog raised with kids cost me $600.00 but hes free to you comes with his Big Crate where he sleeps at night 8 months old come get him please!!!! or hes going to the shelter too much on my plate to deal with right now he needs more attention than we can give him he deserves better."

I would guess one could try to put a value on pain and suffering.... but there is no evidence the dog has been harmed or anything of that nature.

Tough call.
